The Journey Begins

Andrew’s journey to Puerto Vallarta started in 2018 when he and his same sex spouse of 38 years, Dana, began investing in property in the area. Their experience was full of challenges, from dealing with untrustworthy real estate agents to navigating the residency process. These struggles highlighted the need for a reliable network of professionals in Puerto Vallarta—something they wish had existed when they first started.

The Purchase Process

So, what types of problems did we encounter when buying our first property in Puerto Vallarta? Let us start with the purchase process. The real estate agents we found were challenging and argumentative; not pleasant. Arrogant to an extreme (that is a problem in general with many real estate agents in Puerto Vallarta as they try to cover for their incompetence or worse). There were many mistakes made with our purchase of the preconstruction project. Our agent would not listen to me (despite much experience buying /selling real estate) so I discussed my concerns directly with the realtor of the preconstruction project (the arrogant real estate agent yelled at me for doing so). The result was that I settled the issues directly and successfully. That realtor now runs his own company and is on my referral list of realtors! Naturally, the original agent/company is not.

Becoming a Resident

The next challenge was becoming legal in Mexico via residency. Oh, the “bad” real estate agent provided incorrect advice on this; said not to worry about it. Want to bet? In a brief discussion, if you own property in Mexico, you are best to become a permanent resident given the taxation issues in Mexico. Ok, my personal experience is that for whatever reason I was processed as a Temporary Resident while my husband was processed as a Permanent resident. The Mexicans wanted to see a certain asset minimum (which we had), but they still disregarded it in my case. As a Temporary Resident, you have a lot of limits on you that Permanent Residents do not (banking, contracting/employment and so much more). I found being a Temporary Resident limiting and to some degree humiliating and embarrassing since I am a very financially successful person and could not work with the restrictions. I canceled a large project for a business I wanted to develop since I had no ability to sign even a basic contract or do basic banking! I do not want to see you have any problems gaining the correct residency status. My professional network will help you avoid these challenges.

Why is residency so important? Well, non-residents of Mexico will have increased taxes to pay in many cases. The Mexicans will treat you as a non-resident and tax you to the maximum amount possible. The issue of residency becomes even more important if you are intending to rent your property out (Permanent Residency is required to pay your taxes etc).

Creating a Better Process

I had one of the worst experiences with this process! I went through 6-7 professionals (I lost count) who tried to “upgrade” my residency from Temporary to Permanent. 6-7 professionals!!! Insane and cost me a lot of money and time (Four years!). Not helping the situation was the fact that there was an immigration officer in the PV office who absolutely hated people from the USA. Fortunately, this “pendejo” (google it but you can guess what it means) is no longer there and I found an immigration attorney who knows what he is doing, how to avoid problems and is very reasonable on his fees! This person helped me immensely and will help you! But it all starts with the correct realtor and having me as a knowledgeable, connected, person.

Imagine the amount of time, money, and hassle you will be able to save by working with the correct people! I wish that I could have found someone like me years ago!”
